Estate Administration & Guardianship
When someone passes away, their estate (assets and debts) needs to be settled. Estate administration is the process of handling an individual’s assets and liabilities when one passes away. Bankruptcy
Bankruptcy offers a legal framework for individuals and businesses to address overwhelming debt by providing a structured approach to either eliminate certain debts or establish a manageable repayment plan while offering protection from creditor actions. There are several types of bankruptcy, most commonly referred to by chapters of the U.S. Bankruptcy Code, and Cheek Legal specializes in Chapters 7, 11 and 13.
- Chapter 7 Bankruptcy provides a path for individuals and businesses to discharge debt; there is no repayment plan involved in this type of bankruptcy and instead, a bankruptcy trustee is appointed to liquidate all non-exempt assets of the debtor and distributes the proceeds to creditors. This type of bankruptcy provides an opportunity for individuals to have a ‘fresh start’ financially with the discharged debts no longer an impediment.
- Chapter 11 Bankruptcy is a form of bankruptcy that allows individuals and businesses to reorganize their debts and avoid liquidation; specifically, this type of bankruptcy allows individuals and businesses to continue operating and retain assets while reorganizing their debts.
- Chapter 13 Bankruptcy provides a path for individuals with steady income to propose a repayment plan for their debts over a period of three (3) to five (5) years from the date of filing; this form of bankruptcy is designed to help debtors manage and repay their debts and keep their assets.
